The TLA is issued by FSC to organizations that have FSC certificates or apply for certification. Brazil, China, Germany, Russia and the United States will be the first countries to operate under the new licensing agreement, before it is extended to other countries later this year. Certificate holders should keep in mind that signing the license agreement is mandatory in order to maintain certification. The absence of a license agreement signed after December 2010 constitutes significant non-compliance. Companies applying for FSC certification after December 31, 2009 must sign a licensing agreement prior to certification. The Forest Stewardship Council will begin implementing its revised and enhanced trademark licensing agreement (TLA) from the second quarter of 2020. The revised TLA aims to respond to new legal developments, such as the requirements of EU data protection legislation (the General Data Protection Regulation), improve the user experience and strengthen the integrity of the FSC system. The new TLA will introduce new measures to combat false claims (unsealed materials sold under the guise of certification), including a closer review of transactions and possible financial penalties for misrepresentations. All of these measures will improve the integrity and protection of the FSC system, in close cooperation with its stakeholders. It will also be published with a new computer tool that allows a certificate holder to sign and submit the TLA electronically to reduce red tape and manage the contract more easily and quickly.
